Exclusion of Liability, Assumption of Risk, Jurisdiction
These Conditions Will Affect Your Legal Rights
Please Read Carefully.
As a condition of use of the Essa Agriplex facility, the participant(s) assume all risk of personal injury, death or property loss from any cause whatsoever, including but not limited to the risks, dangers, and/or hazards of a Demolition Derby and associated activities of a Demolition Derby. Furthermore, the participant(s) assumes all risk of personal injury, death or property loss resulting from negligence, breach of contract or statutory duty or care, including any duty of care under the Occupiers Liability Act, R.S.O. 1990, C..0.2 on the part of Barrie Fair, Essa & District Agricultural Society and their employees, agents, representatives and sponsors. The participant(s) agrees that the Barrie Fair, Essa & District Agricultural Society and their employees, agents, representatives and sponsors shall not be liable for any personal injury, death and/or property loss.
The participant(s) releases the Barrie Fair, Essa & District Agricultural Society and their employees, agents, representatives and sponsors and waives all claims with respect thereto. The participant(s) agrees that any litigation involving the parties named above shall be brought solely within the Province of Ontario and shall be within the Province of Ontario and shall be within the exclusive jurisdiction of the Courts of the Province of Ontario. The participant(s) further agrees that these conditions and any rights, duties and obligations as between the above named parties and the participant shall be governed by and interpreted solely in accordance with the laws of the Province of Ontario and no other jurisdiction. The liability of Barrie Fair, Essa & District Agricultural Society and their employees, agents, representatives and sponsors is excluded by these conditions.
